1. Agreement

These Terms of Service ("Terms") govern your use of WaveSurgeAI.com and all services provided by Wave Surge AI LLC ("WaveSurgeAI," "we," "us," or "our"). By accessing our website or purchasing our services you agree to be bound by these Terms.

If you do not agree to these Terms please do not use our website or services.

2. Services Offered

WaveSurgeAI provides the following services:

• AI-generated digital art prints available as instant downloads
• Professional website design services — landing pages, full brand sites, and veteran/military specialized sites
• Social media marketing services — content creation, platform management, and campaign strategy
• AI education content — AI After 50 tutorials and free resources
• HRaaS (Human Resources as a Service) platform and related services

3. Digital Art Purchases

All digital art purchases are subject to the following terms:

• All sales are final — no refunds or exchanges on digital downloads
• Upon purchase you receive a personal, non-commercial license to print and display the artwork for personal use
• You may not resell, redistribute, or claim ownership of any WaveSurgeAI artwork
• Commercial use requires a separate commercial license — contact us at info@wavesurgeai.com
• All artwork is AI-generated and disclosed as such per Etsy policy
• WaveSurgeAI retains all intellectual property rights to all artwork

If you experience a technical issue with your download contact us immediately and we will resolve it promptly.

4. Website Design Services

Website design services are subject to the following terms:

• All projects require a signed project agreement and deposit before work begins
• Deliverables and timelines are outlined in the individual project agreement
• Standard turnaround time is 3-5 business days from project kickoff
• Two rounds of revisions are included — additional revisions are billed at an agreed hourly rate
• Final files are delivered upon receipt of full payment
• Client is responsible for hosting, domain registration, and ongoing maintenance unless otherwise agreed
• WaveSurgeAI retains the right to display completed work in our portfolio unless client requests otherwise in writing

5. Social Media Marketing Services

Social media marketing services are subject to the following terms:

• All campaigns require a signed agreement outlining scope, deliverables, and pricing
• Content creation is included in base pricing
• Scheduling and posting services are billed as an additional monthly fee
• Full campaign strategy is billed as an additional monthly fee
• Monthly retainer fees are due at the beginning of each service period
• Either party may terminate services with 30 days written notice

6. HRaaS Services

HRaaS (Human Resources as a Service) platform and related services are subject to separate service agreements. By accessing or using WaveSurgeAI HRaaS services you agree to:

• Provide accurate business and contact information during registration
• Use the platform only for lawful business purposes
• Maintain the confidentiality of your account credentials
• Not attempt to reverse engineer, copy, or redistribute any HRaaS platform components
• Comply with all applicable employment laws in your jurisdiction

HRaaS service pricing, terms, and SLAs are outlined in individual service agreements.

7. SMS Communications

By opting in to receive SMS communications from WaveSurgeAI you agree to:

• Receive text messages related to our services, schedule updates, and HRaaS platform operational notifications
• Message and data rates may apply based on your carrier plan
• Reply STOP at any time to opt out of all SMS communications
• Reply HELP for assistance or contact info@wavesurgeai.com

We do not share your phone number with third parties for marketing purposes.

8. Intellectual Property

All content on WaveSurgeAI.com including artwork, text, graphics, logos, and software is the property of Wave Surge AI LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any WaveSurgeAI content without express written permission.

9. Limitation of Liability

To the fullest extent permitted by law WaveSurgeAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website.

Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the courts of Indiana.

11. Changes To Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page with a new effective date. Continued use of our services after changes constitutes acceptance of the updated Terms.
